Financial abuse perpetrated via the tax code is pervasive and all too common. Domestic violence survivors are often saddled with tax debt incurred during the abusive relationship, adding yet another hurdle to achieving economic independence. Tax returns are signed out of fear, duress or simply forged by the abusive spouse. Power and control ensures survivors are kept in the dark when returns are prepared and filed. Survivors report being unaware of what was being filed; not having access to the tax returns or that they were simply afraid to ask questions. Fortunately, the internal revenue code does provide relief for DV survivors. The IRS explicitly takes DV and abuse into account when evaluating claims for innocent spouse relief. In the most recent report to Congress by the IRS, it was explained that “domestic violence and abuse, including economic abuse, have real consequences for tax administration”.
